1. About these terms
These terms apply to the Discord bot Booversum and the website booversum.com including the dashboard (together "Booversum"), offered by the Booversum team. By adding the bot to a server, using its commands or logging in to the dashboard, you agree to them.
You must also follow Discord's Terms of Service and Community Guidelines.
2. Using Booversum
You may not use Booversum to:
- break the law or Discord's rules, or harass, threaten or spam other people
- attack, overload or try to break into the bot, the website or our servers
- abuse bugs to gain XP, levels or other advantages – please report them instead
- automate actions in the dashboard or the bot beyond normal use
Server admins are responsible for how they set up Booversum on their server, including the texts, images and roles they configure.
3. Premium
Premium subscriptions and items are bought and managed through Discord; Discord's payment terms apply. Premium features may change over time; we try to keep what you already set up working.
4. Availability and changes
Booversum is provided "as is" and "as available". We work to keep it running, but we do not promise that it is always available, free of errors, or that data such as levels, XP, settings or statistics can never be lost. We may change, limit or remove features at any time, and we may pause the bot for maintenance or for reasons outside our control (for example Discord outages, Discord's review of the bot, or problems at our hosting providers).
Booversum depends on Discord. We are not responsible for Discord itself, its availability, its decisions (such as limits, reviews or restrictions of the bot) or for any other third-party service.
5. Responsibility of server admins and users
Server admins decide which features they turn on and how they set them up – including texts, images, roles, permissions, moderation rules and automatic actions (for example kicks, bans or role changes). They are responsible for these settings and their effects on their server and its members, and for making sure their use of Booversum is lawful and fits their community.
Everyone is responsible for the content they create or upload with Booversum (messages, suggestions, images, names) and must have the right to use it. We do not check this content in advance.
You are responsible for keeping your own Discord account secure (for example with two-factor authentication). Actions taken in the dashboard with your account are treated as your actions.
6. Security
We protect the bot, the website and the stored data with reasonable technical measures (for example encrypted connections, access controls and two-factor authentication for our accounts). No system is completely secure, so we cannot guarantee that unauthorized access, misuse or data loss will never happen. If a security incident affects personal data, we will act as described in our Privacy Policy and as required by law.
7. Liability
We are liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
For free features we are not liable beyond that. For paid features (Premium), in cases of slight negligence we are only liable if we breach an essential obligation – one whose fulfilment makes the proper use of the service possible in the first place and on which you may regularly rely – and only for the typical damage that was foreseeable when the contract was made.
In all other cases, liability for slight negligence is excluded. This applies in particular to indirect damage, lost profits, and the loss of data, levels, XP, settings or other in-bot progress, and to damage caused by the settings of server admins, by other users, by Discord or other third parties, or by attackers despite reasonable security measures.
These limits also apply to the personal liability of anyone working on Booversum on our behalf.
8. Indemnification
If someone makes a claim against us because you broke these terms or the law when using Booversum – for example through content you uploaded or settings you made as a server admin – you will indemnify us against that claim, including reasonable costs of legal defence, unless you are not responsible for the breach.
9. Ending the use
You can stop using Booversum at any time by removing the bot from your server. We may restrict, suspend or end access to the bot or the dashboard for anyone who breaks these terms, harms other users, or endangers the service – without prior notice where this is necessary to prevent damage.
10. Your data
How we handle personal data is explained in our Privacy Policy.
11. Final provisions
German law applies. If you are a consumer living in another country, the mandatory consumer protection rules of that country remain unaffected.
If any part of these terms is invalid, the rest stays valid.
We may update these terms; the date at the top shows the latest version. Important changes are announced in our support server. Questions: our support server discord.gg/booversum.
